Frequently Asked Questions from Divorce Lawyers
"As a
collaborative practitioner, how would you work with an attorney in a collaborative
divorce?"
We will work as an objective and neutral financial
professional to help layout what your client's assets and income are and help work to an
agreeable equitable distribution of those assets. We will also help your client and their
spouse work out a realistic and agreeable amount of alimony if that is required as well as
the calculation of child support guideline amounts based upon the income of the parties.
"My
client and I think her husband has under-valued his business. What can I do to determine
its true value?"
If you tell us what kind of business he has, we should be
able to tell you if there is value even before you commit to hiring us to do a business
valuation. Heres how: certain businesses, like a dentistry practice, for instance,
are really only worth the value of the dental equipment, cash, and receivables. You cannot
divide and distribute the goodwill or the reputation that the dentist has built over the
years. But if theres a business with a significant infrastructure in place (i.e.
accounting, office procedures, and staff) that could be sold, there is going to be a value
that could be subject to equitable distribution. We probably wont be able to say
right off the bat exactly what the value is, but I can communicate whether or not a
business valuation is needed.
"I have a
big case coming up that may be larger than my firm has ever handled. Im not sure we
have the office resources here to take it on. Is there anything you can do to help?"
Some attorneys in your situation actually turn down
more complex cases out of fear of getting lost in the financial details. But thats
not necessary. We can assist you in many ways. We can help you manage the documents in the
case so you dont drown in a sea of paper. We can scan all your documents and
organize them for you on compact disks. We can prepare requests for production of
documents, and take care of all those important financial details of a case. Whatever you
need, we are here to assist you with dependable, knowledgeable support.
"My
clients ex-spouse has retained a financial expert. He did a business valuation, and
it just doesnt seem right. Is there anything you can do to help?"
We have received the designation Accredited in
Business Valuation (ABV) from the American Institute of Certified Public Accountants
(AICPA) as well as being a Certified Valuation Analyst (CVA). We can review the other
sides financial documents and come up with questions, an opinion, or views as to
their veracity that will hopefully either comfort your client or provide you with an
alternative course of action. Either way, we are here to assist you with any financial
questions.
"Do
you provide any other services?"
In addition to our divorce litigation services, we
also work in the areas of litigation involving business damages, personal injury, and
wrongful death.
